Identify the duty
Distinguish a listed stopping category from the slowing rule and state school-bus duties.

Apply the rule
Federal § 392.10 lists passenger-carrying buses and specified hazardous-material vehicles. It also gives exceptions. Other CMVs fall under § 392.11: approach slowly enough to stop before the rail and make sure the course is clear. School-bus state and local rules need a separate check.
Why it matters
A rule for one vehicle does not establish another vehicle’s duty. Treating every truck alike can produce either an unsafe crossing or a wrong licensing conclusion.
Avoid this mistake
An empty school bus is not automatically exempt everywhere. An unplacarded cargo tank may still belong to a listed category.
